Generally, agency fees for the purchase of real estate are the responsibility of the owner (seller) because it is he who mandates the agency to find a buyer for him.

Note that agency fees are not added to the displayed price (price including agency fees), as this price already reflects them. However, notary fees will be calculated on the total sale price if the sales mandate specifies that the agency fees are the responsibility of the seller, and the notary fees will therefore be higher.

These fees must follow a set scale and, as mentioned above, can be borne by the buyer or the seller, depending on what is defined in the sales mandate (contract). It is at the time of signing the mandate between the owner and the real estate agent that it is established whether the agency fees will be borne by the seller or the buyer, or whether the fees will be shared between the seller and the buyer (shared fees), a practice that is less common in France today.

Yes of course, we offer free estimates, you must first make an appointment with one of our DV IMMO real estate agents.

Since the ALUR Law of 2014, agency fees are called agency fees. When signing the mandate, it must be established whether the agency fees will be paid by the seller or the buyer.

Fees payable by the seller

*If the fees are to be paid by the seller, the price in the sales advertisement is a total price, it does not indicate any mention.

Fees payable by the buyer

* If the fees are payable by the buyer, the price indicated in the sales advertisement must specify the amount including VAT of the agency fees as a percentage of the net seller's price.

Example: House for sale €210,000 agency fees included, of which 6% VAT-inclusive fees are payable by the buyer.
